TodoPatagonia is a Chilean tourism agency domiciled in Punta Arenas, Chile, acting as a retail tour operator, that is, a commercial entity that manages and organizes tourist packages, products and services, its own or those of third parties, which may include transportation and accommodation. among others.
As a consequence, TodoPatagonia acts as an intermediary between service providers and/or travel operators and the end user or client (hereinafter referred to as “the Client”), giving advice for the planning and purchase of tourist packages and also acts as a tour operator. trips.
TodoPatagonia offers day trips and pre-determined programs. Day tours are predetermined tour packages that last only one day and include transportation, tour guide, excluding entrance fees and food, unless stipulated in the tour offered Default programs are predetermined tour packages that last more than one night and include transportation, tour guide, entrance fees, food and accommodation. They can be offered regularly or individually.
The Client can reserve TodoPatagonia services by email or WhatsApp. It is also possible for the Client to register on behalf of other participants (who will be identified in a list), for whom he/she assumes full contractual responsibility by means of a separate declaration. The contract comes into effect once the reservation is made. It is understood that the reservation is made when the Client receives a travel confirmation document by email from TodoPatagonia.
All communication between TodoPatagonia and the Client will preferably be by email and if this is not possible, by phone or via Whatsapp. In everything that is not provided for in these conditions of use, the Consumer Protection Law (Law No. 19496) will be applicable (Chilean Regulation).
To book the tourist service, the Client will proceed with the following payment schedule which will depend on the selected service package:
2.1 For day trips: 100% of the total trip price must be paid before the start of the tour. Thus, the package will only be considered reserved when 100% of the payment has been made.
2.2 For Programs: 100% of the total program price must be paid before the start of the tour. Thus, the package will only be considered reserved when 100% of the payment has been made. The prices of tourist packages are quoted in American dollars (USD), Mexican pesos (MXN), Brazilian Reals, Euros or Chilean pesos (CLP).
2.3 Regarding Balmaceda and Serrano Navigation reservations:
Our navigation services are subject to weather conditions. When the boat does not set sail, due to technical, climatic or other force majeure reasons, the value of the ticket will be refunded or the date will be modified. If the entire route is not completed, due to technical, climatic or other force majeure reasons, the percentage corresponding to the uncompleted section of the trip will be returned. This situation is the captain’s decision and it must be understood that it is for his safety.

Related details will be provided in the travel confirmation document sent when the reservation payment has been made. The details contained in the travel proposal or on the official website are binding on TodoPatagonia. However, TodoPatagonia reserves the right to declare a change in details before travel confirmation is made in cases of force majeure, act of God or any other unavoidable condition that risks the safe and smooth implementation of the trip, which will be notified before payment of reservation.
Once the tour package is booked, any necessary changes or deviations made in good faith to the original tourist service mentioned in the agreed content of the travel confirmation (including for example but not limited to modifications to the itinerary, or reversing the order of the places to visit), are allowed as long as said changes or deviations are not significant and do not alter the general tour plan.
TodoPatagonia will notify the Client of such changes at least 24 hours before the start of the tourist package (except in cases of force majeure and fortuitous events in which case TodoPatagonia must notify the Client as soon as possible). If in the opinion of TodoPatagonia a significant change to an important service or the total cancellation of the service is made or notified due to circumstances beyond the responsibility of TodoPatagonia or due to situations of force majeure or fortuitous event, TodoPatagonia will notify the Client as soon as possible. possible without being responsible for the refund of money.
Regarding withdrawals, article 3 bis b) of the Consumer Protection Law is not applicable. The cancellation date is the date on which the company receives notice of the Client’s withdrawal, which will be made in writing (by email). Full Day Tour / For Day Trips:
If cancellation is made less than 48 hours before departure date, 100% of the total value of the tour package will be considered a non-refundable booking fee;
If the Client cancels before 48 or more hours of scheduled tour, 100% of the amount paid is returned.
For Private Programs and Tours:
If the cancellation is made 1 to 4 business days before the departure date, 100% of the total value of the tour package will be considered non-refundable;
If the Client cancels 5 to 10 business days before the scheduled tour, 70% of the tour package reservation fee is considered non-refundable;
If cancellation is made before 11 to 20 business days before departure date, 50% of the total value of the tour package is considered a non-refundable reservation fee.
If the cancellation is made before 21 to 30 business days before the departure date, 30% of the total value of the tour package is considered a non-refundable reservation fee.
4.2 Changes to the reservation
Changes to the itinerary are possible as long as they are available and do not generate additional expenses for TodoPatagonia. If not, the cost of changes to the itinerary will be assumed by the Client according to point 4.1.
The Client understands that, depending on the nature of the services offered, he/she may be exposed to risks and elements of possible danger, and that participation in day trips and other tour packages offered by TodoPatagonia involves risks due to the extreme conditions of the weather, danger to property, personal injury and loss of life. The Client agrees that neither he/she nor any of his/her heirs, personal or legal representatives, or family members will sue or claim for injury, loss or damage to property, or loss of life resulting from any action or omission on the part of the Client.
TodoPatagonia assumes that the Client is aware of the risks and dangers of participating in the tourist packages. A medical certificate of the Client’s state of health (proving that the Client is physically qualified to be accepted on the trip) will be required before the start of the tour. If such certificate is not provided by the Client, he/she expressly declares the exemption of Todo Patagonia from liability since the company will not be responsible for any medical illness arising from medical conditions that were not declared by the Client.
In order to prevent unforeseen (and expensive) medical emergencies, TodoPatagonia strongly recommends purchasing travel insurance suitable for the Client’s tour package. Such insurance should include at least personal accident damages and medical expenses (ideally, the provision of an air ambulance if necessary) incurred during the package.
TodoPatagonia is against any type of discrimination and especially against those based on age, race, color, religion, national origin, marital status, disability and gender. The company expressly condemns conduct that condones or incites discrimination. It also rejects any type of sexual harassment or child sexual abuse that occurred during the trips. TodoPatagonia may also require a legal document that certifies the relationship that exists between the child and the adults when it deems it necessary.
The Client is responsible for being in a good enough state of health to participate in the selected trip and for wearing appropriate clothing and appliances as recommended by TodoPatagonia, taking care of personal hygiene, acting appropriately and respectfully according to local custom, and completing the itinerary as scheduled (or as adjusted if applicable).
The Client must collaborate in the event of service interruptions in order to avoid any damage or reduce it to a minimum. He/She shall inform the local tour guide immediately of any complaints she may have.
The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision. Any invalid or unenforceable provision will be deemed severed from this Agreement to the extent of its invalidity or unenforceability, and this Agreement will be construed and enforced as if the Agreement did not contain that specific provision to the extent of its invalidity or unenforceability.
